Please read these Terms of Use carefully before using SmartMarine. By accessing or using our website, you agree to be bound by these terms.

1. About SmartMarine SmartMarine (marketplace.smartmarine.ca) is a price comparison service for Canadian marine parts and equipment. We index publicly listed prices from verified Canadian retailers. We do not sell products, process payments, or hold inventory. We are not a party to any transaction between you and a retailer.

2. Price accuracy Prices displayed on SmartMarine are collected automatically from retailer websites and are for reference only. Prices, availability, and promotional offers may change at any time without notice. The price shown on SmartMarine may differ from the price on the retailer's website at the time of your visit. SmartMarine makes no guarantee that any price is current, accurate, or available. Always confirm the final price and terms directly on the retailer's website before completing a purchase.

3. No warranty SmartMarine provides this service and all information "as is" and "as available" without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

4. Limitation of liability To the maximum extent permitted by applicable Canadian law, SmartMarine, its operators, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to: price discrepancies, failed purchases, shipping delays, product defects, or retailer conduct. Our total liability for any claim arising from your use of the service shall not exceed CAD $100.

5. External links and retailer conduct SmartMarine links to third-party retailer websites for your convenience. We do not control, endorse, or assume responsibility for the content, products, services, policies, or practices of any external website. Your dealings with retailers are solely between you and the retailer. Any disputes regarding purchases must be resolved directly with the retailer.

6. Price alerts The Price Alert feature stores your email address and target price locally on your device and is used to notify you when a product drops below your chosen price. You may remove an alert at any time from the product page. We do not sell or share email addresses collected via price alerts.

7. Prohibited use You agree not to use SmartMarine to: (a) scrape or systematically collect data without our written permission; (b) interfere with or disrupt the service or servers; (c) attempt to gain unauthorized access to any part of the service; or (d) use the service for any unlawful purpose.

8. Intellectual property The SmartMarine name, logo, and all original content on this website are owned by or licensed to SmartMarine's operators. Product names, trademarks, and images remain the property of their respective owners. You may not reproduce or distribute our original content without written permission.

9. Changes to these terms We may update these Terms of Use at any time. Continued use of SmartMarine after changes are posted constitutes your acceptance of the revised terms. We will update the "Last updated" date at the top of this page.

10. Governing law These terms are governed by the laws of Canada and the province in which SmartMarine operates, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of that province.
